Terms of Service

Plain-language terms, accurate to how the service works today. A lawyer's review is planned before wide commercial launch. A shop taking part in a free pilot is also covered by its signed pilot agreement, which prevails where the two differ.

1. The service and the parties

Shop Board Pro ("the service", "we") is a live work-order board for automotive repair shops: a Front Desk, a Shop Floor tablet, a wall Board, a customer Lobby display, an owner Remote and a Store Admin, run in a web browser against a hosted database. It is operated from Toronto, Ontario; when the service is transferred to a corporation, that corporation becomes the party to these terms. "You" is the business that creates a store account and every person it lets sign in.

2. Accounts and seats

A store account is created by an owner with an email address and a password. The owner may invite managers and may create restricted device seats for wall screens and tablets. You are responsible for who you invite, for the passwords and PINs you set, and for everything done from a screen signed in as your shop. Keep wall screens on device seats: a device seat cannot delete work orders, change settings or read credential numbers.

Work orders, rosters, clock-ins, messages, promotions, archives and reports belong to your shop. We hold and process them on your behalf as described in the Privacy Policy, isolate them from every other shop, and never sell them. You can export a day's archive and reports in Store Admin, delete records yourself, and ask us to delete the store entirely. You are responsible for having the right to enter the information you enter, including telling your staff what the board records where the law requires it.

5. Acceptable use

Use the service to run a repair shop. Do not attempt to reach another shop's data, probe the service for weaknesses without our written permission, post unlawful or harassing content to a board or lobby screen, or use the messaging features to send anything Canada's Anti-Spam Legislation would forbid. We may suspend a shop that does, after telling it why.

6. Availability, changes and support

The service is delivered over the internet from hosted infrastructure and is offered as-is. We aim for continuous availability and do not guarantee it; a screen keeps its last state and queues its writes while offline. We ship improvements continuously; a wall screen updates itself when idle and every other screen shows a banner. Support is by email at [email protected].

7. Fees

The service is free during a pilot. Where a paid plan applies, the price, trial and renewal terms are those shown when you subscribe, in Canadian dollars, plus applicable taxes once we are registered to collect them. A lapsed subscription locks the shop's screens; it never deletes the shop's data, and the data is exported or deleted at your request.

8. Intellectual property

The service, its design, and the Shop Board Pro name and logo are ours. You receive a right to use the service for your shop while these terms are in force, and nothing else. Feedback you give us may be used to improve the service without obligation to you.

9. Ending the relationship

You may close your store at any time. We may end the service for a shop on 30 days' notice, or immediately for a serious breach of section 5. In every case your data remains available for export for 30 days after the end, then is deleted on request or under our retention rules.

10. Liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential loss arising from use of the service, including loss of business, a missed or delayed announcement, a delayed board, or a lost day of data. Our total liability for all claims in any twelve-month period is limited to the fees you paid us in that period, or one hundred Canadian dollars where no fees were paid. Nothing in these terms limits liability that cannot be limited by law.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Disputes are heard by the courts sitting in Toronto, Ontario. Questions: [email protected].

12. Changes to these terms

When these terms change, the version and effective date above change and account holders are asked to accept the new version at their next sign-in. Continued use after acceptance is agreement to the new terms.
